Trump Scores Huge Court Win as Judge Allows Voter Citizenship Verification Push to Proceed
Democrats tried to block Trump’s executive order targeting voter rolls and mail-in voting — and lost.
A federal judge has cleared the way for President Donald Trump to move forward with his executive order tightening mail-in voting rules and strengthening voter citizenship verification, delivering a major setback to Democrats challenging the reforms in court.
U.S. District Judge Carl Nichols, a Trump appointee, ruled Thursday that Democrats failed to prove they currently have standing to challenge the order or that they have suffered any actual harm warranting emergency court intervention.
“Given that the Executive Order does not command Plaintiffs to do anything, and that no agency has yet acted pursuant to the Order in a way that could harm Plaintiffs, they have not suffered any harm at present,” Nichols wrote in the ruling.
The lawsuit targeted Trump’s executive order directing federal agencies to assist states in verifying voter citizenship and improving the accuracy of voter rolls, while also imposing tighter controls on mail-in voting procedures.
Democrats argued the order could disenfranchise voters and claimed that proposed state-by-state citizenship databases might contain inaccuracies. But Nichols dismissed those concerns as speculative.
“It remains speculative whether the State Citizenship Lists, if and when they are initially compiled, will contain inaccuracies,” the judge wrote. “Even if they contain initial inaccuracies, the Executive Order requires the adoption of procedures that will allow individuals to access and, if necessary, update or correct their information in the Lists.”
The judge also rejected Democrat claims that sharing voter-related information between federal and state agencies would violate privacy rights.
“Plaintiffs fail to demonstrate that such action — that is, the sharing of name, age, and residence information between and among government agencies, if already known to the federal government — would cause a harm sufficient to establish Article III standing,” Nichols ruled.
The decision marks a significant legal victory for the Trump administration as it pushes election integrity measures ahead of the 2026 midterms. Democrats and left-wing voting groups have repeatedly attacked efforts to require proof of citizenship for voting and to tighten oversight of mail-in ballots, claiming such measures suppress turnout.
Trump and his allies, meanwhile, have argued that stronger voter roll maintenance and citizenship verification are essential to restoring confidence in American elections after years of controversy surrounding election administration.
