Florida Governor Ron DeSantis has often bragged about being the executive in the “free state” of Florida, which has become more conservative under his leadership.
However, Florida has had on its books unconstitutional red flag laws, an Orwellian perversion of due process that takes away an alleged threat’s gun rights under court order before they are convicted of a crime based on an anonymous tip.
“If you look at this red flag law that was passed, You can go in and say, 'this person's a danger, they should have their firearms taken away...' then the burden shifts, where you have to prove to a court you are not a menace or a threat. That's not the way due process works... I think it's a huge due process violation," DeSantis said during a recent press conference.
DeSantis also called for the full legalization of open carry as part of his proposed expansion of 2nd Amendment rights in Florida.
"We see other states that have laws that respect that - I'm for it, I've always been for it. If you talk to most gun owners - very few will actually open carry. They just want to know they can, it's a constitutional right. I'm for open carry,” he said.
DeSantis reiterated in an X post that he wants a full repeal of red flag laws.

“On the Monday morning of November 6, 2018, a 61-year-old man, Gary Willis, was served a red flag gun confiscation order in Ferndale, Maryland.
Two police officers knocked on Willis’ door at 5 AM in the morning to serve him the court order to take his gun.
What seemed like a routine court order delivery, quickly turned violent.
When the officers demanded that Willis hand over his gun, he became irate and a struggle ensued.
Eventually, one of the cops shot and killed Willis during the struggle.
Anne Arundel County Police Chief Timothy Altomare came to the cops’ defense by asserting that they “did the best they could with the situation they had.”
Maryland’s “red flag” law was signed by Republican Governor Larry Hogan in 2018. In October 2018, the first month Maryland’s red flag law went into effect, 114 requests were made to confiscate firearms.”
If DeSantis makes good on his pledge, it will be a major blow against the anti-gun lobby that has successfully gotten these red flag laws enacted in states nationwide without any of those states repealing those laws.
