Memphis City Council Is Pushing Bans On “Assault Weapons” & Constitutional Carry Inside City Grounds
Another blue city tries to undermine pro-gun gains made at the state level.
On July 23, 2024, the Memphis City Council gave the green light to a referendum that would let city residents vote on a measure to enact a citywide “assault weapon” prohibition, a ban on Constitutional Carry, and a red flag gun confiscation, among other gun control measures.
Per a WREG report, the city council’s vote on the referendum means the gun control measures will appear on the ballot on November 5. If these measures are approved, they would be tacked on as amendments to the city charter.
Several of the gun control measures consist of the following:
No person shall be allowed to carry a handgun in the City of Memphis without possessing a valid handgun carry permit.
No person shall be allowed to carry, store, or travel with a handgun in a vehicle in the City of Memphis without possessing a valid handgun permit.
It shall be unlawful for a person to store a firearm, whether loaded or unloaded, or firearm ammunition, in a motor vehicle or boat while the person is not in the motor vehicle or boat unless the firearm or firearm ammunition is kept from ordinary observation and locked within the trunk, utility or glove box, or a locked container securely affixed to the motor vehicle or boat.
The citizens of Memphis hereby find and declare that the proliferation and use of assault weapons pose a threat to the health, safety, and security of all citizens of Memphis.
Hereafter, it shall be unlawful and prohibited for a person to possess or carry, openly or concealed, any assault rifles in the City of Memphis. Persons with valid handgun permits are exempt from this restriction when possessing or carrying an assault rifle on their privately owned property or at a shooting range.
Hereafter, the commercial sale of assault rifles within the City of Memphis is unlawful and is hereby prohibited.
While the Memphis City Council approved the referendum, the city is expected to face several lawsuits if voters approve the gun control measures. This is due to Tennessee’s preemption law.
Most states have laws banning local governments from enacting control measures that are more stringent than state law. In the case of Tennessee, the state’s preemption law bans local governments from regulating the possession, transportation or storage of a gun or firearm ammunition by a lawful handgun carry permit holder in said individual’s vehicle as they use public or private parking areas.
The gun control organization Giffords noted the following about Tennessee’s pre-emption law:
“Tennessee law authorizes parties to file civil suits against state and local governments or local government agencies, departments, or officials if they are adversely affected by an ordinance, resolution, policy, rule, or other enactment that is adopted or enforced in violation of the state’s preemption law, or by the defendant’s creation or maintenance of a gun owner registry in violation of Tennessee’s relevant law.”
Tennessee is one of the most pro-gun states in the nation. According to Guns & Ammo magazine’s most recent best states for gun owners rankings, the Volunteer State is ranked in 8th place. This is a state where gun culture is well-established.
However, that does not mean that Gun Control Onc will stop its fight to undermine the right to bear arms. They’re playing the long game here. The logic is that if one municipality falls in a red state, a domino effect of gun control will be catalyzed.
To stop this process in its tracks, gun owners must be ready to fight at the local level and derail these nefarious plots.
OF COURSE Memphis TN is pushing a ban on rifles and open carry. Those are the kinds of measures you're pushed into when you let your city degenerate into being 63% Negro. Memphis IS NO LONGER AN AMERICAN CITY, much like Detroit, Flint MI, Baltimore, Jackson MS, Birmingham AL. They are third-world African cesspits, because Africans live there and made it so.
Does this ban on assault weapons include knives, baseball bats, frying pans and other items that can be used to assault someone? Just asking
